Your worship, and I want to thank Councilor Brown for his amendment. I personally feel that I'm very interested in what the L C has to. . Has to say about this, but I personally feel that this is a very, very valuable and worthwhile operation to our city to our residents and to the greater community in terms of organic soil production. So, um, I'm happy to support that. And and I just I have to take the occasion your worship because I happen to know that The highest Romans through their company donated donated. I believe it was 2000 bags of of soil to be used as a fundraiser for the track club. So I have to say congratulations on doing that. But that is a separate issue, , and I I am strongly in support of this. Thank you.

Janice Perrino Yes

I if the if the A L C turns this down, I hope this entire council goes down there and fights for this Because what? What a strong business in such a great farming. I mean, I just It doesn't get any better than this. So if they turn this down Will be there for you. That's for sure.

Councilor Pre: No, thank you Worship and again a question through you to staff so Just having a little I understand the agricultural land Commission, um, issues, but my understanding is that this is a, , um Because it's a non farm use. It has to go through as an application to the C. Okay, I get that but in your zoning, history and extent of topsoil processing use Where it's it was permitted than it wasn't permitted. Then it was permitted not permitted not permitted. . Those are our permits. Is that correct? That's not the LCS. It was permitted. It was granted approval through the is that correct, but we but it didn't go with our zoning. And am I understanding that right? ?
City staff answered
clarify that so under the Agricultural Land Reserve regulations yes, it's as far as I understand the timing and the details and this would be for the Land Commission to determine but it's never been permitted beyond the limited scale within the agricultural Land reserve. . And given the nature of the use, it's It's quite complicated, actually, when it comes to soil processing or composting within the agricultural land reserve. Yes, there are provisions within the agricultural Land Reserve regulations to allow composting on a farm. Um, provided. Uh, I guess I think it's effectively the majority of that. . Compost is used on the farm that it's produced. In this case. This is a commercial commercial to sell it. Yes, of course. Correct. Exactly, Um, and with regard to the zoning regulations, although the zoning may have permitted a different times, well, it did permitted at different times. . Um, , the L R regulations did not. . Um And and the zoning was amended to reflect that.

Okay, So do we have to put it through a zoning change ourselves? Is that is that going
City staff answered
To be required? Yeah, through your worship, depending on the decision of the Land Commission right this

Table again. That's right. So if they decide
City staff answered
To permit it as a non-farm use, they may attach conditions; they may place time limits. Limits on scale extent that would sort of determine the path and then the applicant has, um Options, depending on what their intentions are so if the Land Commission were to approve the nonfarm use Um, it would likely return to this table for for consideration in some form, , depending on The Land commission's decision and also the applicants decision on what path they intend to take at that point.

Thanks. I'm just trying to piece it together. Um Other than Like the second option in the staff report. What is envisioned by that? It's just not clear to me what that would look like. .
asked
Uh, through your worship to councilor bounds Question.
City staff answered
So the the idea there is that council may choose to forward the application with comment. Just opening the opportunity up for for comment. The resolution would include comment if council were so inclined
followed up
Right. So in either scenario, though, Comment would go forward. It says. This is contrary to
City staff answered
Zoning and OCP. Yes, that's correct. The staff report will form part of the submission to the Agricultural Land Commission as well. It's intended to kind of outline there. . Based information, the facts and regulations that apply to the property. . Um and then, but in either one or two options one and two One is the recommended option two would allow for the application before worded with council comment if council should choose to do so. And three would be to not for the application to refuse to forward it to the

land commission. So sorry you're worshiping just so a comment could be that That council is supportive of the application.
City staff answered
If? Yeah, if that works councils, prerogative for sure. . Okay, just leaving that opportunity Open.
followed up
Thank you. So the motion on the floor as I understand it is fairly neutral. Um, I would just say that I would personally be in support of adding a comment. Knowing how strict the can be. I would be supportive of having the comments. That council is supportive of the application.
